NOTICE OF VIRTUAL PUBLIC HEARING

  CITY OF DANIA BEACH, FLORIDA

 

A Virtual Public Hearing will be conducted by the City of Dania Beach Planning & Zoning Board on the following date to consider the following application:

 

DATE:                 Wednesday, December 15, 2021

TIME:                 7:00 p.m. or as soon thereafter as the same may be heard

SUBJECT:           VA-095-21: The applicant and property owner, John Bartley, is requesting a variance to permit a new single family home with a side street setback of ten (10) feet, where a minimum of fifteen (15’) feet is required; to permit a four (4) foot wide sidewalk along S.E. 3 Ave., where five (5) feet is required; and to permit a twenty (20) foot wide driveway curb cut where eighteen (18) feet is permitted, for property located at 238 S.E. 2nd Terrace.    

 The following is the proposed Resolution of the matter:

 A RESOLUTION OF THE PLANNING AND ZONING BOARD OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING VARIANCE (VA-085-21) TO SECTION 205-10 OF THE LAND DEVELOPMENT CODE (LDC), TO PERMIT A SIDE STREET SETBACK OF TEN (10) FEET, WHERE A MINIMUM OF FIFTEEN (15’) FEET IS REQUIRED; TO ARTICLE 400 OF THE LDC TO PERMIT A FOUR (4) FOOT WIDE SIDEWALK ALONG S.E. 3 AVE., WHERE FIVE (5) IS REQUIRED; AND TO SECTION 22-5 OF THE CODE TO PERMIT A TWENTY (20) FOOT WIDE DRIVEWAY CURB CUT WHERE EIGHTEEN (18) FEET IS PERMITTED, SUBMITTED BY THE PROPERTY OWNER JOHN BARTLEY, FOR PROPERTY LOCATED AT 238 S.E. 2ND TERRACE, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT “A”, A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.

Please be advised that if a person decides to appeal any decision made by Local Planning Agency, the Planning and Zoning Board or the City Commission with respect to any matter considered at this hearing, such person will need a verbatim record of the proceedings and for this purpose such person may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to based. The City does not provide or prepare such record pursuant to F.S. 286.0105.
